Owuru was ordered to give Tinubu N5 million. Owuru ran against former President Muhammadu Buhari in the 2019 presidential election on the platform of the Hope Democratic Party (HDP).
The former presidential candidate’s new suit calling for Tinubu’s removal as Nigeria’s president was dismissed by the Supreme Court in a unanimous ruling delivered by Justice Uwani Musa Aba-Aji.
The top court also mandated that its Registry refrain from accepting any more pointless originating summonses from Owuru, in addition to the N5 million fine.
Wearing his wig and gown, Owuru attempted to make his own case during Monday’s proceedings, claiming to be a lawyer who was called to the Nigerian Bar in 1984. Prior to being permitted to present his case, he was told to leave the Bar and take off his gown and wig.
After following the instructions, Owuru was questioned about why he had returned to the court after his suits had been dismissed three times.
Although he tried to convince the Apex Court to grant him adequate audience, his explanations were rejected as unconvincing.
Justice Aba-Aji ruled that Owuru’s conduct was unbecoming of a lawyer of over 40 years, as he claimed to be.
In the end, the Court dismissed his suit and ordered him to pay Tinubu N5 million.
As you may remember, Owuru was previously fined N40 million by the Court of Appeal for bringing a lawsuit against Tinubu, INEC, and other parties.
The new suit, marked SC/CV/667/2023, prayed the Apex Court to sack Tinubu over alleged non-qualification to hold office as Nigeria’s President and alleged usurpation of the office in contravention of the law.
Defendants in the suit were former President Muhammadu Buhari, the Attorney General of the Federation and Minister of Justice, the Independent National Electoral Commission (INEC), and Tinubu as 1st to 4th defendants, respectively.
Owuru maintained that he had won the 2019 presidential election, but he claimed that Buhari had usurped his term for eight years. He also asserted that the Supreme Court had technically dismissed his suit against Buhari because of a mismatch in the dates of the hearings.
Additionally, he requested that Tinubu be disqualified by the Apex Court for forfeiting $460,000 to the USA for an alleged drug trafficking offense.
In addition to the purported forfeiture, Owuru denied Tinubu’s eligibility to serve as Nigeria’s president by accusing him of being an active CIA agent.
In order to recover his purportedly usurped mandate, Owuru specifically asked the Supreme Court to use Section 157 of the 1999 Constitution to remove Tinubu from office on the grounds that he was under the control of foreign powers, declare him Nigeria’s president, and order his immediate inauguration.
